Sieva Terms of Service

1. Definitions
These Terms of Service ("Terms") govern access to and use of the Sieva platform provided by Sieva s.r.o., registered at Prague, Czech Republic.
"User" — a natural or legal person accessing the Service through an account. "Service" — the Sieva SaaS platform for hiring automation. "Content" — data entered by the User into the Service (job postings, candidate data, conversations).
2. Registration and Account
Registration requires a valid email address and acceptance of these Terms. The User is solely responsible for keeping their credentials secure and for all activity under their account.
The User warrants that the information provided is accurate and current. Contact details must be kept up to date in account settings.
3. Acceptable Use
The following are prohibited:
- Using the Service to send spam or unsolicited messages.
- Circumventing technical protection measures, reverse engineering, or unauthorized access.
- Infringing the rights of third parties (including GDPR and candidate rights).
- Using the Service for activities that violate the laws of the Czech Republic or the EU.
- Uploading knowingly false information about candidates.
The User bears full responsibility for the lawfulness of collecting and processing candidate personal data through the Service — including obtaining the required consents and complying with GDPR.
4. Pricing and Payment
Access to paid features is provided on a subscription basis. Plan details are published on the Pricing page and form an integral part of these Terms.

5. Intellectual Property
The Service — including its code, interface, brand, and documentation — is owned by Sieva s.r.o. and protected by copyright. The User is granted a non-exclusive, revocable license to use the Service within the scope of these Terms.
Content uploaded by the User remains the User's property. The User grants Sieva s.r.o. a license to store, process, and display the Content solely for the purpose of providing the Service.
6. AI Features and Subprocessors
The Service uses third-party AI models (OpenAI, Anthropic) to analyze candidate conversations, generate messages, and evaluate responses. By using AI features, the User agrees to the transfer of the necessary data to these subprocessors. Details are set out in the Privacy Policy.
7. Disclaimer of Warranties
The Service is provided "as is". Sieva s.r.o. makes no warranty of uninterrupted operation, freedom from errors, or fitness for the User's particular purpose. Use of the Service is at the User's own risk.
8. Limitation of Liability
To the maximum extent permitted by law, the aggregate liability of Sieva s.r.o. to the User for any claim related to the Service is limited to the amount paid by the User for the Service over the preceding 12 months.
Sieva s.r.o. is not liable for lost profits or indirect or consequential damages.
9. Termination
The User may delete their account at any time from account settings. Sieva s.r.o. may suspend or terminate access in the event of a breach of these Terms, with prior notice by email (except in cases that require immediate action).
Following termination, Content is deleted in accordance with the Privacy Policy.
10. Governing Law
These Terms are governed by the laws of the Czech Republic (Zákon č. 89/2012 Sb., občanský zákoník). Disputes are subject to the jurisdiction of the courts at the registered seat of Sieva s.r.o..
11. Changes to the Terms
Sieva s.r.o. reserves the right to modify these Terms. The User will be notified of material changes by email and via an in-Service banner at least 30 days before they take effect. Continued use of the Service after notice constitutes acceptance of the updated Terms.
